Only the following documents will be accepted when processing a property bond through the Gwinnett County Sheriff's Office:

 

If the property is not paid in full: A current mortgage statement and current property tax statement are required.

If the property is paid in full: One of the acceptable deed types listed below and a current property tax statement must be provided. Only original deeds bearing the official certified recording stamp will be accepted. Photocopies or uncertified copies are not acceptable.

  • Quitclaim Deed

  • Warranty Deed/ General Warranty Deed

  • Security Deed

  • Cancellation of Security Deed (Discharge of Deed to Secure Debt)

  • A letter from the mortgage company verifying that the mortgage has been satisfied and the property is paid in full (Satisfaction of Mortgage)

 

If you possess one of the acceptable deed types or required documents listed above, please review the following property bond requirements.

 

Additional requirements include:

  • Ownership and available equity will be verified before the property bond is accepted.

  • All parties listed on the Tax Statement must be present to process the bond.

  • Property that is currently listed for sale will not be accepted.

  • If the property is already being used as surety on another bond, there must be sufficient remaining equity to secure all outstanding property bonds.

  • Property may be located anywhere within the State of Georgia.

  • If the property is located outside of Gwinnett County, the property owner must first obtain an Approved Bond from the Sheriff of the county where the property is located.

  • Property pledged as collateral for a bond may not be sold or transferred until the bond has been released or the associated criminal charges have been fully adjudicated.

  • The Gwinnett County Sheriff's Office does not accept out-of-state property as collateral and will not prepare property bonds for another state.

  • Cash Only- $20.00 bond fee for each active charge.

  • Cash Only- $25.00 warrant fee if applicable * Please ask Bonding Representative*

 

If applicable: A marriage certificate or Social Security document may be required if the name on the identification does not match the name on the property documents.
